    This agreement contains the entire understanding between Ashlee Crystal Photography, and the client. It supersedes all prior and simultaneous agreements between the parties. Any changes to this agreement must be made in writing and agreed to and signed by all parties


    This signed agreement and a 20% or $150 deposit is required to reserve your due date and the surrounding weeks. Full payment of your package is required 3 weeks prior to your due date. A payment schedule is to be followed leading up to this date, unless full payment is received.


    No refunds are given for cancellations made within 30 days within the Client’s due date. Cancellations prior to this forfeit the initial deposit.


    Ashlee Crystal Photography shall be the only hired photographer for this event. Family members and friends are permitted to take photos.


    Coverage begins at active labour and continues until approximately one to two hours after the birth. The photographer is on call 24 hours a day during the time surrounding the client’s due date. The client is responsible for contacting Ashlee Crystal Photography during early stages of labour, immediately before leaving for the hospital, and again when the doctor or midwife confirms active labour. Every reasonable effort will be made to take requested pictures, but no specific pose or photograph can be promised. The Photographer will use her professional judgment and sole discretion to select which photos to deliver. Digital processing may take up to four weeks to complete.

    Hospital guidelines

    The photographer is limited by the guidelines of the hospital policies. The client agrees to accept the technical results of their imposition on the photographer. Due to the typical nature of birth, some grain or blur may be expected.

    Limit of liability

    In the unlikely event that the photographer is injured, becomes too ill or any other unforeseeable event that made it unable for Ashlee Crystal Photography to photograph the birth, responsibility and liability is limited to the return of all payments received for the birth photography package. Ashlee Crystal Photography takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Ashlee Crystal Photography’s control, Ashlee Crystal Photography’s liability is limited to the return of all payments received for the birth photography package. Ashlee Crystal Photography reserves the right to substitute with another photographer. The substitute photographer is chosen at the discretion of the photographer and does not constitute a breach of this contract. Photographer is not responsible for any injuries inflicted upon any participating parties. The client will be responsible for themselves and release photographer from any claims against their person or their business.

    *Please note, due to lighting images can be noisy and film like, however this is completely normal and adds to the rawness of birth photography.

    Unforeseen circumstances

    In the event that coverage of your birth is not able to be provided due to circumstances beyond control, all monies paid will be applied toward a Fresh 48 session. Examples of this include, but are not limited to: failure to provide adequate notice of the baby's birth; an unexpected transport for a C-section; a dramatic change in the birth plan. In instances like this, beyond our control, no refunds will be given.

    Ashlee Crystal Photography takes the utmost care with respect to the post-production and delivery of all photographs. However, in the event that any act which prevents the delivery of the photographs from the birth should occur, liability to you is limited solely to a refund of all money paid.


    Client agrees to assign copyright of all images created during client’s session to Ashlee Crystal Photography. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission.
