By accepting services of the photographer, the client agrees to the terms and conditions outlined within this agreement. Session Fee, Deposit & Inclusions The client agrees to pay the session deposit as discussed with the client and photographer. Payments can be made in cash or via direct deposit The session deposit is a non-refundable retainer, which secures your session date and time. Until the retainer is paid the photographer is unable to guarantee your session date and time. Final images from your session will be provided upon finalising your outstanding balance. Your package includes your session and the number of digital images only as outlined in the package selected by you. Further images and products are available for purchase at an additional cost. Ashlee Crystal Photography does not provide 'RAW' or "unedited' images. If extensive editing is required at the client's request, and additional fee will be required. Delivery of Images You will receive an online gallery link to your selection gallery. Once you have selected your images and finalised payment, your images final images will be retouched and will be sent to you within the gallery link for download. You are responsible for downloading and backing up your images. Copyright The client agrees the Photographer owns the copyright in these photographs including but not limited to all rights in preliminary materials and all electronic rights and hereby waives any claims the client may have based on any usage of the photographs or works derived therefrom, including but not limited to claims for either invasion of privacy or libel. For purposes of this agreement, electronic rights are defined as rights in the digitized form of works that can be encoded, stored, and retrieved from such media as computer disks, hard disks, flash media, removable storage media, computer databases, and network servers. Due to the nature of digital images all orders of digital images are final and non-refundable. The images provided are for personal use only, client agrees not to alter, sell, reproduce or use the images for any other monetary gain. Cancellations & Rescheduling In the event that the client requires rescheduling, a minimum of 72 hours notice is required. The session retainer will be applied to the rescheduled session. Should the client wish to cancel their session, a minimum 7 days notice is required in order to obtain a refund. Cooperation, Responsibility & Damages The client is responsible for any other persons attending the photography session, should other persons be unwilling to abide by requests made by the photographer, such people may be asked to leave. Children must be under control of parents at all times. Any damage made to property due to negligence of the client will be charged to the client. Indemnification & Limit of Liability In the event that all the originals are lost, stolen, damaged or destroyed within or beyond the photographer's control, liability is limited to a refund of all payments received or a reshoot at no additional cost. In the event that photographer is injured, unwell, or for circumstances outside of the photographer's control is unable to attend the session, the photographer will make every effort to reschedule to the earliest possible date. In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. The Photographer shall be held harmless for any and all injury to client and other attending persons during the course of the photography session and the immediately surrounding events.
